These Contract Terms will have an indefinite period of validity and will be applicable to all contracts made through the website www.umuthomes.com.

The OWNER of the WEBSITE informs that the Merchant is responsible and knows the current legislation of the countries to which it offers services, and reserves the right to unilaterally modify, and without prior notice, said Contract Terms, without this affecting to tourist apartment reservations made prior to the modification.

We recommend that the CLIENT periodically consult the Contract Terms, as they may be modified. You can consult the current version of these terms whenever you wish at www.umuthomes.com.

Acceptance of this contractual document means that the CLIENT:

A) Have read, understand what is stated here.

B) That he is a natural person or represents a legal entity with sufficient capacity to contract.

C) That assumes all the conditions and obligations set forth here.

1-INVOLVERS AND IDENTITY OF THE PARTIES:

In the case of natural persons, the reservation of tourist apartments by minors or by legal entities that do not meet the requirements set forth in these Terms of Contract is expressly prohibited.

Making reservations from the Website by a minor who falsifies the registration information will be deemed to have been made under the supervision and authorization of his or her parents, guardians or legal representatives.

2-OBJECT OF THE CONTRACT:

These Contract Terms will regulate the contractual relationship that arises between the OWNER OF THE WEBSITE and the CLIENT for the rental reservation of tourist apartments, made through the online reservation manager that the OWNER OF THE WEBSITE makes available on the website. www.umuthomes.com.

The purpose of this contract is to regulate the contractual relationship for the provision of services born between the OWNER OF THE WEBSITE and the CLIENT at the time the CLIENT makes the reservation and makes the payment for it.

The contract entails the delivery, upon payment of a specific price and publicly displayed through the website, the right to use a specific tourist apartment for a limited period of time.

Contracting through the website www.umuthomes.com will imply acceptance by the CLIENT of these General Terms, as well as acceptance of the conditions of use established for navigation through the website, the mere navigation through it. These conditions will apply without prejudice to the application of the legal regulations on the matter that are applicable to each case.

All accommodations offered are registered in the corresponding regional Tourism and Tourist Activities Registries, having all the necessary habitability permits, being up to date with all payments for their property, real estate tax (IBI). and any other municipal, regional or national tax that may be applicable.

THE OWNER OF THE WEBSITE, GONZALO ALVAREZ, does not assume any responsibility for any damages or losses that may be caused to the CLIENT’s  equipment by browsing the website of the OWNER OF THE WEBSITE, when such damages or losses are not caused for direct responsibility attributable to the OWNER OF THE WEBSITE.

THE OWNER OF THE WEBSITE reserves the right to make any modifications it deems appropriate, without prior notice, to the General Conditions.

These modifications may be made, through the website www.umuthomes.com, in any manner admissible by law and will be mandatory during the time in which they are published on the website and until they are validly modified by subsequent ones.

3-DESCRIPTION OF THE TOURIST APARTMENTS:

In compliance with current regulations and, especially Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the OWNER OF THE WEBSITE offers through the website www.umuthomes. com, depending on the type of tourist apartment in question, information about it, its characteristics and prices.

Any modification to the price established in the listings of each destination after selection of dates is considered an offer.

Offers on the apartments of the OWNER OF THE WEBSITE may only be effective by booking directly through the website www.umuthomes.com, by calling +34 658.753.457 or by sending an email to reserva@umuthomes.com.

 These offers will not be cumulative with other offers. Each specific offer may have additional conditions to those set out above (duration, particularities, dates, etc.) that will be described in each case.

The tourist apartments offered, as well as others that could be offered in the future through www.umuthomes.com, may be used by the CUSTOMER in exchange for the corresponding remuneration to be paid by them, and will confer on them a right of use. on them, subject to the deadlines, conditions and terms of these General Terms and the particular conditions that, where appropriate, are established.

However, THE OWNER OF THE WEBSITE reserves the right to withdraw or change the offer of tourist apartments offered through the website www.umuthomes.com, by simply changing their content.

In this way, the tourist apartments offered at all times on the website www.umuthomes.com will be governed by the General Terms in force in each case. Likewise, THE OWNER OF THE WEBSITE will have the right to stop offering, without prior notice and at any time, access to the mentioned tourist apartments.

The descriptions, which are established in each case, will regulate the provision by the WEBSITE OWNER of the tourist apartments offered to the CLIENT.

The availability of the tourist apartments offered by THE OWNER OF THE WEBSITE through the website www.umuthomes.com may vary depending on CUSTOMER demand.

4-FORM OF PAYMENT OF THE RESERVATION AND DEPOSIT:

The rental prices of tourist apartments are always shown in the Euro currency (€) and include the corresponding Value Added Tax (VAT) or other taxes that may be applicable and which will be in force at all times.

The prices shown on the website www.umuthomes.com apply exclusively to the tourist apartments offered through said website and for as long as they remain published.

THE OWNER OF THE WEBSITE expressly reserves the right to modify prices at any time without prior notice. However, in any case, the rates in force indicated at the time of making the corresponding reservation will apply.

The prices applicable to each tourist apartment will be those published on the website www.umuthomes.com and applied automatically by the contracting process in the last phase of the contract.

Any payment made to the OWNER OF THE WEBSITE will entail the issuance of an invoice in the name of the registered CUSTOMER. Said invoice will be automatically sent to the email address provided by the CLIENT.

You expressly authorize us to issue the invoice in electronic format, although you may indicate to us at any time your wish to receive an invoice in paper format, in which case, we will issue and send the invoice in that format.

For any information about the reservation, the CUSTOMER may contact THE OWNER OF THE WEBSITE through the telephone number +34 658.753.457 or the email address reserva@umuthomes.com. In any case, it must be indicated in the subject of the message  the reservation number that was assigned and indicated in the reservation confirmation email.

To proceed with the payment, the CUSTOMER must follow each and every one of the instructions shown on the website www.umuthomes.com. Payment of the rentals of the tourist apartments can only be made through the payment methods indicated at any time on the website.

As a payment system, there are several payment methods established on the website www.umuthomes.com for the CLIENT to make the reservation based on the selected property:

– Bank transfer: The CLIENT may pay for the reservation by transfer.

– Card payment: The CLIENT may pay for the reservation with their Credit/Debit card.

The payment of the deposit for the tourist apartments will be made via retention/collection on the credit/debit card prior to the client’s arrival, through a link to a payment gateway, with an amount of up to €250 depending on the property criterion.

Once the contracted stay has ended and after inspection of the tourist apartment, the retention placed on the client by the deposit will be released within a maximum period of 72 hours from the departure date.

In the event that there are damages to the accommodation, it will be deducted from the deposit deposited and in the event that damages was greater than the amount of the deposit, the OWNER OF THE WEBSITE will take the relevant legal actions against the CUSTOMER.

5-CHECK-IN AND CHECK-OUT:

The day before the reservation, it is mandatory to use the main contact telephone number that appears in the reservation document to confirm an approximate time of arrival as possible, as well as specify how to communicate during the day in which the CLIENT is traveling to your holiday destination in the city of ALICANTE.

In the event that there is a change or delay in the arrival time, the CUSTOMER must notify the OWNER OF THE WEBSITE through the telephone number provided, either by phone call, SMS or WhatsApp, leaving a record of the prior notice.

The reception of the OWNER OF THE WEBSITE to the client may be carried out personally or electronically according to the configuration of the apartment, being at the discretion of the property, as well as the way to deliver the instructions on the operation of the different elements that make up the apartment. , places of interest, shops, restaurants, how to get around, parking (if any), etc.

Entry into the apartment can be made from the time specified for each apartment. If the CLIENT wishes to occupy an apartment or house before said time, he/she must contact the OWNER OF THE WEBSITE to try to organize the reception earlier ONLY IF THE OWNER OF THE WEBSITE CONFIRMS THAT IT IS POSSIBLE SINCE THE TOURIST APARTMENTS ARE SUBJECT TO AVAILABILITY.

The LIMIT time to leave the apartment on the day of departure is 11:00 am, this being an EXCLUSIVE term. If the CUSTOMER wants to leave the apartment or vacation home later, please contact the corresponding telephone number to make this request and ONLY IF THE OWNER OF THE WEBSITE CONFIRMS THAT IT IS POSSIBLE SINCE THE TOURIST APARTMENTS ARE SUBJECT TO AVAILABILITY, will you be able to leave later of the LIMIT time.

*The hours between 4:00 p.m. and 10:00 p.m. check-in will be free, during the hours from 10:00 p.m. to 1:00 a.m. entry to the TOURIST APARTMENT OR VACATION HOUSE WILL HAVE A SUPPLEMENT OF €30 WITHOUT EXCEPTION and after 1:00 a.m. The supplement will be €45.

6-OCCUPATION AND POLICY OF CHILDREN:

The maximum capacity, the number of beds and their layout are indicated in the apartment file on the website www.umuthomes.com.

All children, regardless of their age, count when calculating the maximum capacity of the accommodation; this capacity can never be exceeded by adding adults and children.

Except for occasional visits, it is not permitted to occupy an accommodation by a number of people greater than that declared when making the reservation. If it is necessary to accommodate more people, the OWNER OF THE WEBSITE must be notified and the rental conditions could be modified.

On the other hand, pets in the accommodation will have a cost of €6 per night for each pet.

In the event of non-compliance with any of these conditions, the OWNER OF THE WEBSITE reserves the right to demand the immediate abandonment of the accommodation and the termination of the contract, without the client being able to request compensation of any kind for the execution of this measure, and being obliged to pay the remaining amount if it exists.

7-CHANGES IN THE DURATION OF THE STAY:

All cancellations or changes to the length of stay must be made in writing via email. Cancellations or changes are not accepted over the phone. In case of date changes, the OWNER OF THE WEBSITE reserves the right to accept the modification.

If the CLIENT generates a new reservation with the intention of modifying the dates, it will be understood as a new stay and the cancellation conditions will apply. In any case, if you must modify your stay you must contact the OWNER OF THE WEBSITE to find the best possible solution.

If, due to circumstances beyond the control of the OWNER OF THE WEBSITE, such as breakdowns, floods, fires or any other cause of force majeure, the agreed accommodation cannot be offered to the CLIENT, THE OWNER OF THE WEBSITE may change said accommodation for another with similar characteristics. In the event that the CLIENT does not agree with the proposed accommodation, he may cancel his contract and obtain a refund of the amount he had paid, except, where applicable, in the part that corresponds to the rental period that would have been enjoyed. The OWNER OF THE WEBSITE will not assume any other responsibility for the total or partial cancellation of the stay.

8-RULES OF CONDUCT:

Rest hours are from 10:00 p.m. to 8:00 a.m., so it is mandatory not to generate noise or disturbances during this time period. Smoking is not allowed in the accommodation, except on balconies, terraces and gardens. Loud music and Parties are prohibited.

The person holding the accommodation reservation contract will be responsible for the correct behavior of all accommodation occupants. Neither the OWNER OF THE WEBSITE nor the owner of the accommodation are responsible for any type of damage, direct or indirect, that may be caused as a result of misuse by the tenant, including without limitation, losses due to fire. , theft, accidents or other types of damage.

The CLIENT, upon signing the reservation contract, will be subject to correct and decent behavior on the part of all the people accompanying him or her. If this person, or any person accompanying him or her, does not behave appropriately and responsibly, it will determine the end of the contract and the OWNER OF THE WEBSITE will have the right to ask the CLIENT and the people accompanying him or her to leave the accommodation without the right to future claims or any type of compensation and in addition, the tenant will be obliged to pay the outstanding rent if any, also assuming the loss of the deposit.

THE CUSTOMER has the obligation to leave the accommodation in good condition, tidy and presentable. Garbage generated in his stay must be removed from the accommodation. For the latter, there are containers near the accommodation. If not, the OWNER OF THE WEBSITE reserves the right to cover any extra expenses through the deposit.

Booking an apartment with www.umuthomes.com implies absolute and unconditional acceptance of these conditions. In case of non-compliance, the OWNER OF THE WEBSITE may unilaterally terminate the contract immediately, and evict the guests at any time of the day or night.

9-RIGHT OF WITHDRAWAL:

When the CLIENT is a consumer and the contract is concluded online, the CLIENT will enjoy the right of withdrawal described in this section.

The period for exercising this right is 14 calendar days from the execution of the contract for the provision of services, without penalty for its exercise.

To comply with the withdrawal period, it is sufficient for the communication regarding your exercise of this right to be sent, in the form and substance described, before the corresponding period expires.

In the event that withdrawal is appropriate, the OWNER OF THE WEBSITE will refund the CLIENT for the reservation made, less the derived expenses (bank amounts, commissions, currency exchange…), which will be borne by the CLIENT, using for this the same payment method used by the CLIENT for the initial transaction, unless the CLIENT has expressly provided otherwise and as long as the CLIENT does not incur any expenses as a result of the reimbursement.

For the right of withdrawal, the CUSTOMER must notify his decision to withdraw from the contract through a declaration made in any form permitted by law.

Online dispute resolution:

10-EVENTS OUTSIDE OUR CONTROL:

11-CANCELLATIONS:

The cancellation policy of www.umuthomes.com includes Non-Refundable Rates and Refundable Rates.

In Non-Refundable Rates, no amount will be returned under any circumstances.

In Refundable Rates the following cancellation policy will apply:

Up to 7 days or more before the Client’s arrival, there are no cancellation fees.

If you cancel within 7 days prior to your arrival, the 20% charged will not be refunded.

If you cancel less than 48 hours before your arrival, the full amount of the reservation will not be refunded under any circumstances.

If a refund is applicable, the amount of the currency will always be in euros.

These conditions are only applicable to reservations made directly from the www.umuthomes.com platform. If the reservation is made through another reservation channel, the cancellation policies that will be applied will be those indicated by the channel through which the reservation was made.

12- INFORMATION ON THE PROCESSING OF PERSONAL DATA:

The guarantee of the services offered will respond to the articles based on Law 23/2003, of July 10, on Guarantees for the sale of goods and consumption.

17-JURISDICTION:

These general conditions are governed by Spanish law. The parties submit, at their option, for the resolution of conflicts and waiving any other jurisdiction, to the judges and courts of the user’s domicile. In the event that the user is domiciled outside of Spain, THE OWNER OF THE WEBSITE and the CLIENT renounce any other jurisdiction, submitting to the Courts and Tribunals closest to MUTXAMEL-ALICANTE.

If any clause included in these General Conditions is declared totally or partially null or ineffective, these General Conditions will subsist in everything else and such provision will be considered totally or partially not included.

Likewise, these Conditions are subject to any other provision, regulation or law that is directly or indirectly applicable to them.
